1. Description of the Service

RigSize Live is a Progressive Web App (PWA) for the watersports community. The app offers the following features:

• Real-time sharing of location and gear data (sail size, board volume, kite size) with other users
• Spot Chat — a chat feature per surf spot with support for text and photos
• Leaderboards and session history
• Database of 600+ Dutch surf spots
• Integration with third-party fitness platforms (e.g., Garmin Connect) for automatic activity synchronisation

2. Acceptance of Terms

By opening, registering with, or using RigSize Live, you confirm that you have read, understood, and accepted these terms of service. If you do not agree with these terms, please do not use the app.

RigSize Live is a free service. No charges are applied for using the app.

3. Account and Registration

Certain features (saving sessions, chat, leaderboards) require an account. When creating an account:

• You are responsible for keeping your login credentials confidential
• You guarantee that the information provided is accurate and up to date
• You are responsible for all activity that takes place under your account
• You must report any unauthorised use of your account to us immediately

RigSize Live reserves the right to terminate accounts that violate these terms.

5. User Generated Content

RigSize Live allows users to post content via the Spot Chat feature, including text messages and photos.

5.1 Ownership and Licence

By posting content:

• You retain ownership of your content
• You grant RigSize Live a non-exclusive, royalty-free, worldwide licence to display, process, and distribute your content within the app
• You agree that chat messages and photos are automatically deleted after 7 days

5.2 Prohibited Content

It is not permitted to post content that:

• Is illegal, threatening, abusive, defamatory, or obscene
• Is discriminatory on the basis of race, gender, religion, nationality, disability, sexual orientation, or age
• Contains sexually explicit material
• Glorifies violence or incites hatred
• Is aimed at bullying, intimidating, or harassing others
• Infringes on the intellectual property rights of third parties
• Contains personal data of others without consent
• Contains spam, advertising, or unsolicited commercial messages
• Contains malware, viruses, or harmful code
• Contains false identities or misleading information

5.3 Moderation and Enforcement

RigSize Live reserves the right to:

• Remove content that violates these terms without prior notice
• Temporarily or permanently suspend accounts for violations
• Investigate user reports and take appropriate action
• Cooperate with law enforcement if legally required

We are not obligated to pre-screen all user content but reserve the right to do so at any time.

5.4 Reporting and Blocking

Users can report inappropriate messages via the report function in the chat. Additionally, you can block individual users. We encourage you to report inappropriate content so that we can keep the community safe.

6. Code of Conduct

When using RigSize Live, you agree to the following rules of conduct:

• Treat other users with respect
• Do not use the app to stalk, intimidate, or harass others
• Do not share false or misleading information about surf conditions or gear
• Do not attempt to disrupt or manipulate the technical operation of the app
• Do not use the app for commercial purposes without prior written permission
• Do not attempt to gain unauthorised access to other accounts or systems

7. Location Data

RigSize Live uses GPS location data for the following purposes:

• Displaying your position on the real-time map to other active users
• Automatically determining the nearest surf spot

Location sharing is only active during an ongoing session. You can stop sharing your location at any time by ending your session. See our Privacy Policy for more information on how we handle your location data.

8. Third-Party Integrations

RigSize Live may offer integrations with third-party fitness platforms such as Garmin Connect. When you connect a third-party account:

• You authorise RigSize Live to access your activity data from that platform via the official OAuth 2.0 consent flow
• We only retrieve watersport-related activities (windsurfing, kitesurfing, wing surfing, sailing)
• You can disconnect the integration at any time, after which no new data will be retrieved
• Use of third-party platforms is subject to their respective terms and privacy policies

RigSize Live is not responsible for the availability, accuracy, or completeness of data provided by third-party platforms.

9. Intellectual Property

The app, including but not limited to the software, design, logos, images, icons, and the surf spot database, is the property of RigSize Live and is protected by copyright and other intellectual property rights.

Without prior written permission, it is not permitted to:

• Copy, modify, or distribute the app or parts thereof
• Reverse-engineer or decompile the source code
• Extract the surf spot database for personal use
• Use the RigSize Live brand or logo

10. Availability and Warranties

RigSize Live is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee uninterrupted or error-free operation.

RigSize Live is not liable for:

• Decisions you make based on information in the app, including gear selection and assessment of weather conditions
• Damage resulting from the use of the app during watersport activities
• Loss of data, including session data and chat messages
• Content posted by other users
• Inaccuracies in location data, surf spot information, or third-party activity data
• Interruptions in service due to technical issues or maintenance

11. Limitation of Liability

To the extent permitted by law, the total liability of RigSize Live is limited to the amount you have paid for the use of the service. In no event shall RigSize Live be liable for indirect, incidental, special, or consequential damages.

12. Third-Party Services

RigSize Live makes use of third-party services, including Supabase (authentication and data storage), Firebase/Google Cloud (chat and photo storage), Garmin Connect (activity data synchronisation), Vercel (hosting), and OpenStreetMap/Leaflet (map display). The use of these services is subject to their respective terms.

13. Termination

You may stop using RigSize Live at any time. We may terminate or restrict your access if you violate these terms, without prior notice. Upon termination, your active session data will be removed from the real-time map.

14. Changes to These Terms

We reserve the right to modify these terms at any time. In the event of significant changes, we will notify users via the app. Continued use after publication of modified terms constitutes acceptance.

15. Governing Law

These terms of service are exclusively governed by Dutch law. Any disputes arising from or related to these terms shall be submitted to the competent court in the Netherlands.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
